Terms & Conditions

Welcome to the DRM Landscaping, LLC website. By accessing this site or engaging our services, you agree to the following terms and conditions. These terms are designed to ensure a transparent, professional, and meticulous partnership between DRM Landscaping (“we,” “us,” or “our”) and the property owner (“client,” “you”).

1. Scope of Services

DRM Landscaping provides high-end landscape stewardship, masonry, and yard renovations. The specific scope of work for any project will be outlined in a written proposal or contract. Any additions or "change orders" requested after the initial agreement may result in additional charges and timeline adjustments.

2. Estimates and Proposals

  • Validity: Proposals are valid for 15 days from the date of issuance due to the fluctuating costs of premium materials (stone, plants, fuel).
     

  • Acceptance: A project is considered scheduled only upon receipt of a signed proposal and the required deposit.

3. Client Responsibilities

To maintain our "Clean Exit" standard and ensure the safety of our team, we ask that you:

  • Access: Provide unobstructed access to the service areas on scheduled workdays.

  • Safety: Ensure the work area is clear of pet waste, toys, and debris.

  • Utilities: Identify and mark any private underground lines (invisible fences, private lighting, irrigation) not covered by public utility marking services (DigSafe).

4. Payments and Billing

Maintenance: Recurring maintenance services are billed monthly and are due upon receipt.


Projects: Large-scale renovations and masonry projects typically require a 50% deposit to secure the start date and materials, with the remaining balance due immediately upon completion.

Late Fees: A late fee may be applied to any balance remaining unpaid after 30 days.

5. Living Materials & Warranty

While we source the highest quality New England hardy varieties, plants are living organisms. Our warranty on plantings is contingent upon the client following the hydration and care instructions provided in our Seasonal Stewardship Calendar. We are not responsible for plant failure due to neglect, drought, extreme weather events, or pest infestations beyond our control.

6. Intellectual Property

All content on this website, including but not limited to the New England Estate Calendar, technical "Trade Secrets," and drone photography, is the exclusive property of DRM Landscaping, LLC.

 

  • Photography: We reserve the right to use "Before and After" photographs and drone imagery of projects for marketing and portfolio purposes, while respecting the privacy and anonymity of the client’s specific location.

7. Limitation of Liability

DRM Landscaping, LLC is fully insured. However, we are not liable for damage to unmarked underground private utilities, or for "acts of God" (heavy storms, flooding, frost heave) that may impact the landscape. Our liability is limited to the total value of the service contract.

8. Governing Law

These terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts and the State of Rhode Island. Any disputes shall be resolved in the courts of the jurisdiction where the service was performed.
